HOW TO EVICT A TENANT QUICKLY IN NEW JERSEY

So, what’s the quickest way to get tenants out?

If your current tenants are not respecting your property then you probably are trying to figure out how to get them out as soon as possible.  In order to evict a tenant quickly in New Jersey, the tenants would have to have broken rules in your contract, or you need to follow a series of steps to legally evict them. We will list some different options that you can try to evict a tenant quickly.

Offer to pay them to leave

The first thing that you can try to do is offer the tenant money to move out. This may work, but only if they have somewhere else they can go and if the money is important enough for them to move and it will be the quickest way to evict a tenant. Most people will move out if you pay them enough money-but they may require more than you want to pay. It may be more cost effective to have them remain on the property.

If your tenants are not interested in you paying for them to leave then here are a few options that you have.

Accelerated eviction procedure

Don’t get confused with the accelerated procedure. Here are some of the facts about it. If you are looking for a way to quickly get bad tenants out this is not the fastest option.

  • It takes between six to ten weeks once you issue the proceedings to the court order.
  • You can only use this order to get possession based on section 21. In order to be able to do this, you have to serve a section 21 first and the fixed term has to have ended.

So although this is a legal way to have a tenant evicted, it is not the quickest way to do so.  

A Standard eviction

If you have an AST a standard eviction is possible, this, however, can take three to six months. There is no way to push this process to go quickly as it can actually delay it. All you can do is wait through the steps and act promptly to make sure everything you need to turn in is perfect to prevent further delay.

Look for ways the tenants are breaking their contract

If your tenants are damaging the property, or doing something illegal in the home, then you can call the cops. They may be required to move out because of a broken contract. But remember even if they are arrested you can’t go in and change the locks. You will need to wait and make sure it is all legally okay for you to have them evicted.

Unfortunately, once a tenant has been handed the keys to the property you lose control over it. You can only get it back if the tenants move out voluntarily or you have a court order for possession. This can take months, and will not help your situation.

One way that you can get rid of tenants is to sell the property. However, the tenants have to stay because there are still stipulations.  

Consider these following valid reasons that you can say tenants can be evicted in your property.

  • Failure to Pay Rent

Evict a tenant in New Jersey when he/she fails to pay the rent on time. Landlords may accept the fact that sometimes tenants could be having trouble in paying the rental property. The lease agreement can be adjusted somehow if it is reasonable. However, when tenants abuse your patience often, it is better to evict them and give a prior notice.

  • Disorderly Conduct of the Tenant

Evicting a tenant due to misbehavior and bad conduct is a “good cause”. This covers spontaneous disturbances to peace and order in your property. If landlords are not at home, mostly this reason emerges through reports from adjacent rooms/tenancy. 

One visible example of this content is when a tenant brings over his friends for some kind of parties. People get drunk, may do violence, resulting in disturbing next-door tenants. It violates not just the lease agreement or contract but as well as the environmental act. 

To stop the nuisance, landlords may send a warning notice to the tenant. If proved nothing has changed, you may report it and gradually evict the tenant.

  • Damage to Property

Landlords can definitely do changes in the written lease agreement. Tenants should adapt to the changes in order to stay in the property. However, if the tenant refuses the change in the legal terms, the landlord can be able to evict the tenant and serve a Notice to Quit.

  • Tenants Threatens the Landlord and his Family

Assaulted threats verbal or non-verbal to the landlord, family, relative or to the employees of the landlord can lead to eviction. If a tenant pleads guilty to such offense, they can be evicted quickly.
